According to the ACLU, Tsarnaev is no different than any other criminal defendant. However, when it comes to deciding whether or not Miranda rights should be given to him before police questioning, Government officials disagree.
Government officials revealed that Tsarnaev would not be given Miranda warnings when he was physically able to be interrogated. Government officials said they will be invoking the public safety exception. Under this exception, investigators are allowed question suspects without first reading them their rights for up to 48 hours. This exception is invoked when the government believes information is needed to protect public safety.
Tsarnaev was given his Miranda rights after 16 hours of questioning and immediately invoked his right to remain silent.
If you have been charged with a crime or are under investigation for criminal activity, it is imperative that you consult with an experienced criminal defense lawyer as soon as possible.
